General Terms and Conditions

1. Scope and Applicability

1.1 thermal-services.org provides its services exclusively based on the following General Terms and Conditions (GTC).

1.2 Deviating agreements are only valid if agreed upon in writing.

1.3 In case of discrepancies between the order and these GTC, the provisions of the order shall prevail.

1.4 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions and the contracts concluded on their basis shall not be affected. The invalid provision shall be replaced by a valid one that corresponds to its purpose and intent.

1.5 thermal-services.org provides its services exclusively within the USA.

2. Conclusion of Contract

2.1 The devices shown on the thermal-services.org website are for illustrative purposes only. Delivery of these devices depends on availability. There is no entitlement to delivery at the stated prices.

2.2 Specific offers for delivery and installation are made in writing by thermal-services.org and sent to the customer. A contract is concluded upon receipt of the customer's written acceptance by thermal-services.org. Offers must be accepted in full; partial acceptance is not possible.

2.3 The service offers listed on the website constitute an invitation to submit an offer (invitatio ad offerendum). Acceptance occurs through confirmation of the requested service date by thermal-services.org.

2.4 Orders can be placed in person, by phone, or online.

3. Scope of Services and Order Processing

3.1 The scope of services to be provided is based on the offer prepared and sent by thermal-services.org.

3.2 Special and additional services must be paid for separately by the customer. Details are provided in the offer.

3.3 Execution begins once the contract becomes legally effective (after any withdrawal period ends) and a date is agreed upon with the customer.

4. Right of Withdrawal

4.1 Services are also offered on the website and contracts are concluded using remote communication methods.

4.2 Consumers may withdraw within 14 days if the agreed price exceeds €200.00 or if the contract does not involve immediate maintenance work.

4.3 The consumer may withdraw from the contract within 14 days without giving any reason. The withdrawal must be declared to thermal-services.org. The withdrawal form available on the website may be used.

5. Service Deadlines and Dates

5.1 Service provision takes place after the withdrawal period ends.

5.2 Specific dates are arranged individually with the customer.

5.3 Delivery and completion dates are only binding if explicitly confirmed.

5.4 Services will be rendered within 6 weeks after the consumer's withdrawal period ends.

5.5 thermal-services.org will inform the customer immediately if products are unavailable and will offer alternatives.

6. Liability

thermal-services.org is liable only for property damage caused by gross negligence or intentional misconduct by its employees or agents.

7. Payment, Retention of Title

7.1 The invoice amount is due upon full completion of the contract.

7.2 Payment can be made in cash on-site or via instant online transfer. Payment via debit or credit card is not possible.

7.3 All goods delivered and installed remain the property of thermal-services.org until full payment is made.

8. Warranty

8.1 thermal-services.org provides warranty under statutory provisions for defect-free performance.

8.2 New devices may come with a manufacturer's warranty. This becomes void if third parties, including thermal-services.org, intervene afterward. During the warranty period, the manufacturer’s service must be contacted first.

8.3 The warranty period begins when the customer accepts the work, or at the latest, when invoiced.

8.4 Warranty cases are only handled during normal business hours. Emergency services related to warranty issues must be paid for separately.

9. Governing Law, Place of Performance, Jurisdiction

9.1 USA substantive law applies, excluding conflict of law rules and the UN Sales Convention.

9.2 The place of performance is Boise.

9.3 Jurisdiction is agreed to be the competent court at the registered office of thermal-services.org. thermal-services.org may also sue customers at their general jurisdiction.

9.4 Where personal terms are stated in the masculine form, they refer equally to women and men. When referring to specific individuals, the appropriate gender-specific form must be used.

10. Data Protection

The client agrees that their personal data (name/company, profession, date of birth, company number, legal representatives, contact person, business address and other addresses, phone number, fax number, email, bank details, credit card data, VAT number) may be collected, stored, and processed automatically for the purpose of fulfilling the contract, customer service, and for the company’s own marketing (e.g., sending offers, brochures, newsletters in print and electronic form), and to reference an existing or past business relationship. The client agrees to receive promotional emails until this consent is revoked. Consent may be revoked at any time in writing via email, fax, or letter to thermal-services.org.
